It is an Annual Assessment.
3. Do I have
to belong to the Homeowners Association?
YES - It is mandatory - a legal entity agreed to when
you closed on the purchase of your home.
4. If I don't
pay my dues what are the legal remedies?
See Covenants, Article V -Sec. 5&6, Three notices
are sent - late fees are charged then a lien is filed
against the property which includes, interest, attorney
fees, notary fees, recording fees and accrued late charges.
5. What changes to my property

6. Can I replace my roof with
wood shake shingles because that's what the
covenants require?
No. The City of Colorado Springs passed an ordinance
in 2002 requiring ALL roofing material must be CLASS
A, banning wood shake shingles. An ordinance takes precedence
over covenants.
7. Who do I contact for approval
of improvements?
The Architectural Control Committee Chairman (ACC).

8. How do I report
violations of the covenants in my neighborhood?
Submit a letter to the Covenant Compliance Chairman.
See Board Members link. Please include your name and
a method of being contacted. We need to be able to discuss
your concern directly with you.
9. What are the rules for parking
motor homes, trailers or large commercial vehicles
in Discovery?
A motor home or trailer may only be parked for loading
or unloading for up to three (3) days each way. (A variance
may be granted for a short extension by contacting the
Board). No motor home or trailer may be stored on the
property unless in can be concealed from the street
and ANY other property behind approved fencing. No commercial
size vehicle may be parked on the property on a regular
basis. See Article III, Section 13, Covenants.
10. Does the Homeowner's Association
own Common Property?
No.
11. Who is responsible
for the Creek Area?
Homeowner's are responsible up to their lot line markers.
The City of Colorado Springs owns and maintains the
Creek Bed and adjacent land. Note: Tree trimmings, grass
clipping and other debris should not be disposed of
on any property adjoining the creek.
12. Why do our
Delmonico street signs say "Delmonico Blvd"
and the City signs at the main intersection say "Drive"?
In the original subdivision Plat it was designated "Blvd"
- City ordinance changed those designations about 10
years ago to comply with roadway descriptions. It is
very costly to change those signs, but we hope to be
able to do that at some time.
13. Why doesn't the city repair
the sidewalks, curbs and gutters?
The city has recently (2005) assumed that responsibility.
As budget and crew constraints allow, they will repair these items.
14. Can I change the mailbox
post to some other style?
No. They are a part of the architectural neighborhood
design. See Article III, Sec. 6d.
15. Are the Discovery street
signs owned by the Association?
Yes. They are maintained by the Association.
16. Should I
have received a copy of the covenants when I purchased
my home?
Yes. Your realtor or Title Co. should have provided
you with a copy. Please refer to the Covenants/Bylaws/Forms
link to download the covenants in PDF form if you need
one.
17. Do all the
filings in Discovery have the same covenants?
Yes. All 9 filings were amended to conform on January
28, 1980 and are recorded with the El Paso County Clerk
and Recorder.
18. I notice there are replacement
materials being used that do not meet the covenant description.
How are these approvals determined?
The ACC (Architecture Control Committee) realizes that
newer products should be considered and they evaluate
those requests when submitted.
19. Can the Board
of Directors order exterior maintenance be done by an
outside contractor if the owner has been negligent in
maintaining the property?
Yes. After giving the owner a 6 months notice. The owner
will then be charged the cost of the maintenance done
against future assessments or an assessment lien will
be filed against the property. See Article VI, Section
1-4, Covenants.
20. Why don't
you amend the covenants to make them consistent with
current and future building materials and drought resistant
landscaping?
It takes 51% of the lot owners to approve amendments
through a petition/notary process vote. The Board is currently
in the process of developing proposed amendments to be presented
to the homeowners as soon as possible.

22. What types
of wildlife are prevalent in Discovery?
Black bears, deer, rabbit, fox, raccoons, coyotes, bobcats,
mountain lion, snakes, eagles, falcons, owls and a large
variety of migratory and local residing birds.
23. What is the
average length of residency in Discovery?
15 years.
24. Is there a Neighborhood
Watch program?
No, not at this time.
25. How can I
get involved as a Discovery resident?
Contact one of the Board Members or submit your name
at the Annual Meeting in November. The board is always
happy to have a volunteer run for an elected position
on the Board.
